By downloading, installing, or using the HapyTap application or website at hapytap.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service. These Terms constitute a legally binding agreement between you and Kalash, Inc.
HapyTap is a mobile-first platform that enables users to send small, symbolic digital gestures of acknowledgment to people they care about. The service includes a sender flow (selecting a moment, artifact, and optional note), a recipient ceremony experience, and a thank-you return flow.
HapyTap does not facilitate payments, financial transactions, or the delivery of physical or digital goods with monetary value in its current beta version.

By using HapyTap during beta, you acknowledge and accept these limitations.
You must be at least 13 years of age to use HapyTap. By using the service, you represent that you meet this age requirement. If you are between 13 and 18 years of age, you represent that you have parental or guardian consent to use the service.
To use certain features of HapyTap, you must register for an account using your phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree not to use HapyTap to:
You retain ownership of any content you create within HapyTap, including the notes you write to recipients. By submitting content, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit that content solely for the purpose of delivering the service to you and your recipient.
You are solely responsible for the content you send. We do not pre-screen user content but reserve the right to remove content that violates these Terms.
All rights, title, and interest in and to HapyTap, including the application, design, artifacts, animations, and branding, are owned by Kalash, Inc. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our express written consent.
Your use of HapyTap is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
HapyTap is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Kalash, Inc. disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, or error-free, or that defects will be corrected.
To the fullest extent permitted by applicable law, Kalash, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of goodwill, or service interruption, arising out of or in connection with your use of HapyTap.
Our total liability to you for any claim arising from or related to these Terms or the service shall not exceed the greater of $100 USD or the amount you paid to us in the twelve months preceding the claim.
We reserve the right to suspend or terminate your access to HapyTap at any time, with or without cause, and with or without notice, particularly if you violate these Terms. Upon termination, your right to use the service will immediately cease.
You may terminate your account at any time by contacting us at privacy@hapytap.com. Account deletion requests will be processed within 30 days.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the date and notify you via email or in-app notice. Your continued use of HapyTap after changes are posted constitutes your acceptance of the revised Terms.
